Terms of Use

Preamble

These Terms of Use (the “Terms”) set out the terms and conditions governing the use of the services offered by the Swiss Transcript platform (the “Platform”), published by Swiss Machina Sarl (“Swiss Machina”), for its private and business customers (the “Users”).

1. Description of the Services

Swiss Transcript provides an online service for automatic transcription and the generation of minutes/reports from audio and video files into text, accessible via a secure web interface hosted in Switzerland.

Through our platform, our customers can:

Swiss Transcript places strong emphasis on confidentiality and data security: all data is processed and hosted in Switzerland, without using foreign servers.

2. Acceptance of the Terms

Use of the service is subject to acceptance of, and compliance with, these Terms. Any access to and/or use of the website implies the User’s full and unconditional acceptance.

3. Pricing and payment

Swiss Transcript bills its automatic transcription services per minute of processed audio/video. The base rate is CHF 0.20 per minute.

Payment is made per use, after the customer validates the quote automatically calculated based on the total duration of the imported files. No subscription or recurring fees apply to the per-minute offer.

Discounted credit packs and monthly or annual subscriptions are also available for more frequent needs or larger volumes, with decreasing rates. For higher volumes, the subscription price may average around CHF 3 per hour.

Payments are processed via the secure solution of our partner SaferPay / SixPayment, ensuring a reliable transaction for our customers and for us.

4. Access to the service

4.1 Account creation

Using Swiss Transcript requires creating a personal account. When registering, the User undertakes to provide accurate, complete and up-to-date information, including their first name, last name and email address and, for business customers requesting invoicing, the company name and billing address.

4.2 Login credentials

Once registered, the User accesses their account using their email address and password. These credentials are strictly personal and confidential.

The User undertakes not to disclose them to third parties and to maintain a sufficiently strong password so that it cannot be guessed.

4.3 Account suspension or deletion

Swiss Machina reserves the right to temporarily suspend or permanently delete a User’s account, without prior notice or compensation, in the event of a breach of these Terms, abusive or fraudulent use of the service, provision of inaccurate information, or upon order of the competent authorities.

4.4 Trial period

Each new User receives a free credit of 30 minutes of transcription, to be used during their first month of registration. Beyond that, or after the end of this period, use of the service becomes paid, in accordance with the pricing in force on the User’s subscription date.

5. Use of the Service

5.1 Purpose of the service

The User undertakes to use the service in accordance with its purpose, for content for which they hold the necessary rights and which does not infringe public order, public decency or third-party rights.

The service is provided “as is”, without any guarantee of continuous availability or absence of errors. The generated transcripts require review by the User.

5.2 Service quality

Swiss Machina implements appropriate technical means to provide a high-quality automatic transcription service. However, given the fully automated nature of the processing, Swiss Machina cannot guarantee a perfect transcript, free of errors or approximations.

Transcript quality depends on many factors such as the audio quality of the source file, accents, background noise and technical or specialised terms over which Swiss Machina has no control.

Therefore, the transcripts provided must always be considered a working basis requiring review and corrections by the User before any use.

5.3 Service availability

Swiss Machina endeavours to maintain accessibility and proper operation of the Swiss Transcript platform 24/7. However, given the technical complexity of the service and its reliance on electronic communications networks, Swiss Machina cannot guarantee permanent and uninterrupted availability.

Access to the platform may be temporarily suspended, without prior notice or compensation, notably for maintenance, updates, in the event of a cyberattack, or at the request of the authorities.

Swiss Machina undertakes to minimise the frequency and duration of such downtime as much as possible.

6. Delivery times

Transcription is generally delivered within a few minutes after payment validation by the customer, thanks to our state-of-the-art algorithms.

Processing time may vary slightly depending on the duration and audio quality of the source files.

7. Warranties and liability

Swiss Transcript makes every effort to provide the best possible transcription quality. Nevertheless, service performance may be affected by the audio quality of the source files provided by the customer.

In the event of a total transcription failure attributable to a malfunction of our platform, the customer will be fully reimbursed by way of a credit of an equivalent amount on their account, usable for future services.

These provisions do not apply in the event of poor audio quality of the source files provided by the customer, who remains responsible for ensuring that their files are suitable for our service.

The User assumes full responsibility for the content they submit for transcription. They undertake to process only files for which they hold the rights of use.

8. Personal data

Providing the service requires the processing of personal data, carried out in accordance with our privacy policy.

The servers are located exclusively in Switzerland. The data is not subject to any transfer outside Swiss territory and benefits from a high level of protection in line with Swiss legal requirements.

9. Confidentiality and data security

Swiss Transcript places the highest importance on the confidentiality and security of its customers’ data:

All processing complies with Swiss and European legal requirements (FADP/LPD, GDPR).

10. Intellectual property

All components of the Swiss Transcript platform (software, algorithms, interfaces, etc.) are the exclusive property of Swiss Machina and are protected as such by intellectual property laws.

Any partial or total reproduction or representation without authorisation is strictly prohibited.

However, the source files submitted by Users and their transcripts remain their exclusive property. Swiss Machina acquires no rights over such content and may use it only strictly for the purpose of performing the transcription service, with the User’s consent.

11. Changes to the Terms

To continuously adapt to Users’ expectations and comply with legal developments, Swiss Machina may modify these Terms.

Any new version will apply immediately upon publication on the website www.swisstranscript.ch, for both existing and new Users.

We therefore invite Users to regularly consult the latest version of the Terms available online.

By continuing to use Swiss Transcript after the Terms have been modified, the User unreservedly accepts the new version. If the User does not agree with these changes, they may request closure of their account at any time.

12. Governing law and jurisdiction

These Terms are governed by Swiss law.

In the event of a dispute, the competent courts are those of the Canton of Vaud, Switzerland.

By using the Platform, the User acknowledges having read these Terms and accepts them without reservation.
