Terms of Use

Preamble

These Terms of Use (hereinafter "Terms") aim to define the terms and conditions of use of the services offered by the SwissTranscript platform (hereinafter "the Platform"), published by the company Swiss Machina Sarl (hereinafter "Swiss Machina"), for its individual and professional clients (hereinafter "Users").

1. Service Description

SwissTranscript offers an online service for automatic transcription of audio and video files into text. Through our secure web interface, our clients can:
- Upload their audio or video files (interviews, meetings, conferences, lectures, videos, etc.)
- Initiate the automatic transcription of these files using our speech recognition algorithms adapted to French. In a few minutes, without human intervention, the oral content is converted into text.
- Obtain the result in the form of an RTF text file which they can download.

Our service is available to both individuals (students, researchers, content creators) and professionals with confidentiality concerns (administrations, media, psychologists, HR coaches, etc.).

2. Acceptance of the Terms

Using the service is subject to the acceptance and compliance with these Terms. Any access and/or use of the site implies the full and unconditional acceptance of the User.

3. Pricing and Payment

SwissTranscript charges for its automated transcription services by the minute of audio/video processed, at a flat rate of 0.20 CHF/EUR per minute.
Payment is made per transaction, after the client validates the quote automatically calculated based on the total duration of the uploaded files. No subscription or recurring fees are applied.
Payments are made via the secure solution of our partner SaferPay/SixPayment, ensuring a reliable transaction for both our clients and ourselves.

4. Access to the Service

4.1 Account Creation

Using SwissTranscript requires the creation of a personal account. During registration, the User agrees to provide accurate, complete, and up-to-date information, including their first name, last name, email address, and, for professionals requiring invoicing, the company name and billing address.

4.2 Login Credentials

Once registered, the User accesses their account using their email address and password. These credentials are strictly personal and confidential. The User agrees not to disclose them to third parties and to maintain their password strong enough to avoid it being guessed.

4.3 Account Suspension or Deletion

Swiss Machina reserves the right to temporarily suspend or permanently delete a User's account, without notice or compensation, in case of violation of these Terms, abusive or fraudulent use of the service, provision of inaccurate information, or on the request of the competent authorities.

4.4 Trial Period

Every new User receives a free credit of 30 minutes of transcription to be used during their first month of registration. After this period, or once it expires, the service becomes chargeable according to the rates in effect at the time of the User's subscription.

5. Use of the Service

5.1 Purpose of the Service

The User agrees to use the service in accordance with its purpose, for content they have the necessary rights to and that does not violate public order, morals, or third-party rights. The service is provided "as is", with no guarantee of continuous availability or error-free operation. The transcriptions generated require proofreading by the User.

5.2 Service Quality

Swiss Machina makes every effort to provide a high-quality automated transcription service. However, given the fully automated nature of the process, Swiss Machina cannot guarantee a perfect transcription free from errors or approximations.
The quality of the transcriptions depends on several factors, such as the audio quality of the source file, accents, background noise, technical or specialized terms, which Swiss Machina cannot control. Therefore, the transcriptions provided must always be considered as working material requiring proofreading and corrections by the User before use.

5.3 Service Availability

Swiss Machina strives to maintain access to and proper functioning of the SwissTranscript platform 24/7. However, due to the technical complexity of the service and its dependence on electronic communication networks, Swiss Machina cannot guarantee permanent and uninterrupted availability.
Access to the platform may be temporarily suspended, without notice or compensation, for maintenance, updates, cyberattacks, or requests from authorities. Swiss Machina commits to minimizing the frequency and duration of these outages.

6. Delivery Times

Transcription is generally delivered within a few minutes after payment confirmation, thanks to our cutting-edge algorithms.
Processing time may vary slightly depending on the duration and audio quality of the source files.

7. Guarantees and Responsibilities

SwissTranscript makes every effort to provide the best possible transcription quality. However, the service performance may be affected by the audio quality of the files provided by the client.
In case of complete transcription failure due to a malfunction of our platform, the client will be fully refunded with a credit of the equivalent amount to their account, usable for future services.
These provisions do not apply in case of poor audio quality in the source files provided by the client, who remains responsible for ensuring the suitability of their files for our service.
The User assumes full responsibility for the content they submit for transcription. They agree to only process files for which they hold the necessary rights of use.

8. Personal Data

The provision of the service requires the processing of personal data, carried out in accordance with our privacy policy. The servers are exclusively located in Switzerland, and the data is not transferred outside Swiss territory, benefiting from a high level of protection in compliance with Swiss legal requirements.

9. Data Confidentiality and Security

SwissTranscript places the highest importance on the confidentiality and security of its clients' data:
- All files and data are encrypted and stored exclusively on secure servers in Switzerland
- No data is transferred outside Swiss territory
- Access is strictly reserved for authorized employees bound by confidentiality clauses
- Source files are automatically deleted once transcription is complete
- Transcriptions are stored securely until deleted by the client

All processing is in compliance with Swiss and European legal requirements (LPD, GDPR).

10. Intellectual Property

All elements of the SwissTranscript platform (software, algorithms, interfaces, etc.) are the exclusive property of Swiss Machina and are protected by intellectual property laws. Any reproduction, modification, or unauthorized use of the platform’s content is strictly prohibited.
The User remains the owner of the files and content they upload to the platform. However, by using the service, the User grants Swiss Machina the right to process and store their data for the duration of the transcription service.

11. Updates and Modifications of the Service

Swiss Machina reserves the right to modify, suspend, or discontinue any feature or service offered by SwissTranscript, including pricing or available functions, without prior notice. Users will be informed of any major changes that could impact their use of the service.

12. Applicable Law and Jurisdiction

These Terms are governed by Swiss law. In case of dispute, the courts of Lausanne (Switzerland) will have exclusive jurisdiction.

Your account data is retained for the duration of your registration. Audio/video files are deleted from our servers once transcription is completed. Transcription files are retained until deleted by the User or the account is closed. You can request the deletion of all your data at any time.
